Is CAPD a disability, learning disability, or both?

I'm wondering if CAPD would be considered a disability. Perhaps it would be if it is severe enough? Our son has normal hearing, but is significantly impaired with CAPD. Do you think he would qualify for a disability like a deaf child? I ask because apparently our county has in-class services for hard of hearing children, and I wonder how to approach them to see if he qualifies for these services. Another mother said she believes he has to have a hearing disability to get these services. Anybody have any ideas?

Debbie, this is an interesting question. I don't know the answer. I wonder if the Americans with Disabilities Act defines specific disabilities. I tried to search, but couldn't find a way to search the text. I found the definition in the California Code:

(a) "Individual with a disability" means, with respect to an individual (1) having a physical or mental impairment that substantially limits one or more major life activities of such individual; (2) having a record of such impairment; or (3) being regarded as having such an impairment.


From my struggles with special ed I know CAPD is not specifically defined as a learning disability, but it falls under the IDEA general description of learning disability which is:

The term ``specific learning disability'' means a disorder in 1 or more of the basic psychological processes involved in understanding or in using language, spoken or written, which disorder may manifest itself in the imperfect ability to listen, think, speak, read, write, spell, or do mathematical calculations.

So it sounds like it may fall into the general category of disability if the impairment limits the person's ability to function in life. Chances are with therapy the individual can compensate enough to function in life. It would be interesting to hear from adults with CAPD and how they manage with jobs, family, etc.

some work has been done to have APD recognised in the USA as a disability over the last decade, but not to sure of the progress as I have lost contact with those lobbying for this.

In the UK we are months away from have APD officially recognised as a listening Disability, with the new universal diagnostic tests being the key part of the recognition process.

According to what our school told us, using the 504 is pretty much saying that he does have a disability, and they treat his condition as such.  Since this 504 will follow him through the rest of his school years, I'd say it pretty much constitutes a disability.

APD is a listening disability.
and following the various statutory requirements in each country or state for official recognition is more about politics than scientific understanding of the issues.
There was a group lobbying for USA recognition of APD as a disability in 2000 and beyond, but i have been concentrating on having APD recognised in the UK and lost contact with those working in the USA.

My daughter attends school in Western Australia.

The Education Department here has the policy that CAPD (and dyslexia) are "learning difficulties" and not "learning disabilities" and as such provide no funding for necessary equipment etc.

Sooooooo frustrating!

i was told each case varies as it depends on the "severity of every situation." i call it a learning disability yes, it impairs our learning many ways times ten!! A hearing disability is kinda accurate as this is easier 2 explain 2 those who dunno & i am tryin 2 bring about awareness or simply, talking on my behalf. many ppl r rude, opinionated saying CAPD is not a real disorder or that, they too, have such sypmtoms yadi yadi yada...do not ever let anyone undermine ur condition. this is where those who dunno and judge and tal outta their ....  smile  i been told im stupid or do not try hard enuff or whatever, i heard everything degrading me as a person who has a true and very confusing disability. whether or not it is listed in the statistics or i am able 2 claim SSI 4 it, i kno, my doctor knows, my mother(who passed it on2 me), and that is all that matters. if so be it, lay out everything 4 whoever "needs" it 4 proof it being a disability. y r we subjected 2 defend our unvoluntarily act of not being able 2 process what we hear correctly or learn jus as well as those w/o any disabilities?? we need 2 stick 2gether & not be fooled by those who cannot possibly relate 2 our lives & what we go thru. THANK U 4 ur time, the end smile

Thank you for your input, Brit. I do agree we must keep fighting and doing what we can to raise awareness. Last month our family moved to a new town in hopes of finding a school where our son would be more accepted. We lucked out and the move has been good. He is accepted and treated normal at school, and there are no issues at all with bullying (phew!).

Yet, already the speech therapist in the new school has questioned his CAPD diagnosis, saying he was too young to be tested (6-1/2). I offered to give her the assessment from the audiologist to let her know the diagnosis is official, not observational. I tried to be nice, but as I walked away I felt myself fuming. What I really wanted to say was, "Don't even question this. You really don't want to see me get angry -- and I will get angry! You have no idea how hard I've had to fight to get my son help for this."

I don't really understand why there is so much resistance in the schools against CAPD. Although, my older sister is dyslexic, and I remember when we were children my mother had to go through a lot of hoops to get her help. She had to put her into private school because the public school had not support (early 70's). So perhaps we are in those early stages with CAPD, and in time it will be something the schools will support.

In the meantime, I'm so joyful our son is happy in his new school. Kids being mean is the worst stress in the world, and just aggravates everything. At least now he has a chance of making friends and fitting in!

You are better than me dear, because the last person who tried to deny this issue got strong words from me.  I've stopped being nice to the nay-sayers, they don't know my son like I do.  I'm sure if it was THEIR child, it would be a different story. 

Tell Ms. Speech Therapist that you will give her the indepth testing you had done, and that you have no reservations about pulling your child from school and doing homeschooling if he's not given what he needs.  I was all ready to do that with our son before we met with the school.  I still would in a heartbeat if they try to give me grief over this.

HELP  PLZ!! I was diagnosed w CAPD as a teen, can I get disability now @ the age of 28 or do I need to be re diagnosed as an adult?! Anyone know?!
